Qué es el RETA y qué diferencias existen con el Régimen General

La Seguridad Social tiene varios sistemas para cotizar en función de las características y situación personal y profesional de las personas. 

No es lo mismo ser un empleado de una empresa, que ser un empresario autónomo que ha creado un negocio.

El tratamiento que hace la Seguridad Social de estos dos colectivos es distinto y tendrán que afiliarse cada uno a su régimen de la Seguridad Social: RETA o Régimen General. 

El Sistema de Seguridad Social 

El RETA y el Régimen General son sistemas de afiliación a la Seguridad Social mediante los que las personas que realizan una actividad profesional o empresarial, aportan económicamente sus cotizaciones. 

En España, el siempre discutido sistema de la Seguridad Social es solidario y contributivo. Esto significa que aquellas personas obligadas a cotizar a través de cualquiera de estos dos regímenes, aportan una cantidad económica, que va destinada a cubrir las prestaciones tanto contributivas como no contributivas del sistema: bajas, desempleo, jubilaciones y otros tipos de prestaciones de protección social.

¿Qué es el RETA y el Régimen general?

El RETA es el acrónimo de Régimen Especial de Trabajadores Autónomos. Es el sistema de la Seguridad Social de los trabajadores por cuenta propia o autónomos.

En el RETA están obligados a cotizar los siguientes colectivos:

  • Los trabajadores por cuenta propia mayores de 18 años que realicen una actividad económica a título lucrativo, de forma habitual, personal y directa, sin sujeción a contrato de trabajo.
  • Cónyuge y familiares hasta el segundo grado inclusive que colaboren con el autónomo.
  • Los trabajadores autónomos económicamente dependientes (TRADE).
  • Los autónomos extranjeros que trabajen en España.
  • Los profesionales por cuenta propia, que requiera la incorporación a un Colegio Profesional.
  • Los socios de Cooperativas.
  • Los comuneros o socios de comunidades de bienes y sociedades civiles.
  • Los administradores de entidades mercantiles, si ejercen funciones de dirección y gerencia, a título lucrativo y de forma habitual, personal y directa, siempre que posean el control efectivo, directo o indirecto de la sociedad.

Por otro lado, el Régimen General de la Seguridad Social, es el sistema por el que cotizan los trabajadores por cuenta ajena o empleados.

Principales diferencias entre el RETA y el Régimen General

Entre las principales diferencias entre ambos regímenes de la Seguridad Social, destacan las siguientes:

Base de cotización

En el RETA, se puede elegir la base de cotización entre una base mínima y una máxima. En el Régimen General, ya viene determinado por el puesto a desempeñar.

Jubilación

La prestación por jubilación es donde más se notan las diferencias. La prestación de jubilación de los autónomos del RETA son de media un 40% menores que los que han cotizado en el Régimen General. 

Esto es así porque en el RETA se puede elegir la base de cotización. En este caso el 90% de las personas se deciden por la base mínima de cotización, lo que da lugar a importes de prestación menores.

Cotización a pagar

En el Régimen general, la cantidad a cotizar y pagar a la Seguridad Social por contingencias comunes se establece en base al salario en la nómina. En el caso del RETA, este paga lo que se llama la cuota de autónomo, que se calcula como un porcentaje en función de la base de cotización elegida. Ambos sistemas, pagan mensualmente estas cotizaciones.

Derecho a paro

En el Régimen general se tiene acceso a la prestación por desempleo, mientras que los autónomos tienen derecho a la prestación por cese de actividad, con unos requisitos más complicados de cumplir para muchos de los autónomos que deciden cerrar su negocio.

No hay que olvidar que ambos regímenes de la Seguridad Social son compatibles, en lo que se conoce como pluriactividad. Se puede cotizar en el Régimen general, trabajando por cuenta ajena, y crear un negocio como autónomo, dándose de alta en el RETA.
