Qué es el SII y cómo adaptarte a él como pyme

El Suministro Inmediato de Información (más conocido como SII) es un sistema creado por la Agencia Tributaria para facilitar la gestión del IVA en las empresas, que se basa en el envío casi inmediato de todos los registros de facturación de una empresa. Entró en vigor el 1 de julio de 2017.

Cómo funciona el SII

Para facilitar la gestión del SII, la Agencia Tributaria establece un protocolo de comunicación entre sus sistemas y los sistemas empresariales de las empresas (ERP). Se envían todos los registros de facturación de la empresa, para que así Hacienda disponga en tiempo real de toda la información necesaria relativa al IVA.

La puesta en marcha del SII elimina la necesidad de la presentación de otros modelos del IVA. La Orden HFP/417/2017 establece que los sujetos pasivos que utilicen el SII no estarán obligados a presentar el modelo 390 de declaración-resumen anual del IVA, aunque se deberá seguir presentando el modelo 303.

Retrasos y sanciones por incumplimiento de plazos en el SII

El SII es un sistema que hace que todas las facturas, tanto emitidas como recibidas, sean remitidas de forma inmediata a la Agencia Tributaria. No obstante, los plazos fijados legalmente para enviar esta información son los siguientes:

  • Facturas expedidas: 4 días naturales desde la emisión de la factura.
  • Facturas recibidas: 4 días naturales desde que se produce el registro contable de la factura.
  • Bienes de inversión: debe remitirse la totalidad de los registros dentro del plazo de presentación correspondiente al último periodo de liquidación de cada año natural.
  • Operaciones intracomunitarias: 4 días naturales desde la expedición o transporte.

Las sanciones por incumplimiento de estas obligaciones son del 0,5% del importe de la factura objeto de registro, cuando el retraso se refiera al Libro Registro de facturas expedidas y facturas recibidas, con un mínimo trimestral de 300 euros y un máximo de 6.000 euros.

Qué empresas están obligadas a acogerse al SII

Las empresas que cumplan los siguientes criterios tienen la obligación de acogerse al SII:

  • Aquellas que estén acogidas al Régimen de Devolución Mensual (REDEME).
  • Grandes empresas con una facturación igual o superior a 6.010.121,04 euros.
  • Estar acogido al régimen de grupos de IVA.

Asimismo, el SII también será de aplicación al resto de sujetos pasivos que, voluntariamente, decidan acogerse al mismo.

Soy una pyme, ¿me interesa acogerme al SII?

Desde la puesta en marcha del SII, son muchas las pequeñas empresas que, sin estar obligadas a utilizar este sistema, se preguntan si realmente es interesante o no utilizarlo. La digitalización y la globalización está creando un entorno económico totalmente nuevo y en constante evolución, y el sistema tributario no iba a ser una excepción.

Evidentemente, la adaptación al SII supone un coste que no todas las empresas puede permitirse. Esta ha sido la razón principal por la que, por el momento, el SII únicamente es de obligado cumplimiento para grandes empresas. Pero el objetivo es que el SII se aplique a todas las empresas, con independencia de su tamaño.

En consecuencia, la adaptación al SII será una realidad para todas las pymes, como ya lo es para las empresas acogidas al REDEME. Y esto requerirá adaptar los sistemas empresariales a esta necesidad.

Para ello, a la hora de elegir una solución, hay que tener en cuenta diferentes factores:

  • Debe ser lo suficientemente flexible como para adaptarse a los diferentes cambios legislativos. Desde su entrada en vigor hace 3 años, el SII ha sufrido diferentes modificaciones, de manera que es importante que la herramienta ofrezca la posibilidad de modificar su trazabilidad.
  • Tiene que tener la capacidad de integrarse con los sistemas de la empresa con el objetivo de garantizar su automatización.
  • Debe poder monitorizarse para detectar errores y reenviar la información a la Agencia Tributaria para evitar posibles sanciones por parte de Hacienda.
